Welcome to Elaré. By accessing our website, browsing, or purchasing, you agree to these Terms. Please read them carefully; if you do not agree, do not use our website or place an order.
1. Acceptance — By ordering you confirm you are at least 18 (or the age of majority in your location), that your information is accurate and belongs to you, and that you accept these Terms, our Privacy Policy, and our Return & Refund Policy. We may refuse service, cancel orders, limit quantities, or deny future purchases where we believe our policies have been violated.
2. Product Information — Elaré sells dietary supplements. We aim for accuracy in descriptions, images, pricing, and availability but do not guarantee all content is error-free, and details may change without notice. We may correct errors, update information, or refuse orders affected by inaccuracies.
3. Pricing & Availability — Prices are in USD and may change at any time. Placing an order does not guarantee acceptance; all orders are subject to review, availability, payment confirmation, fraud screening, and policy compliance.
4. Orders & Payment — You confirm you are authorized to use the payment method provided. Orders may be held, reviewed, delayed, or cancelled for suspected fraud, payment issues, incorrect information, pricing errors, promotion abuse, or high-risk signals. Payment must clear before processing, and we may request additional verification.
5. Subscriptions — Subscribe & Save plans are billed every two months at a discounted rate and reflect a two-month commitment. They cannot be paused or cancelled mid-cycle for change of mind; you may cancel future renewals before your next billing date. See our Return & Refund Policy for details.
6. Shipping & Delivery — Delivery times are estimates only and not guaranteed. Customers must provide accurate information. Once handed to the carrier, Elaré is not responsible for courier delays, customs, missed deliveries, or packages marked delivered.
7. Returns & Refunds — Handled per our Return & Refund Policy, which forms part of these Terms. For hygiene reasons, only unopened, sealed products in original packaging, approved in advance, are eligible. Original shipping is non-refundable, and return shipping is the customer's responsibility.
8. Dietary Supplement Disclaimer — Our products are dietary supplements, not medicines, and are not intended to diagnose, treat, cure, or prevent any disease. These statements have not been evaluated by the Food and Drug Administration. Information on our site is for general purposes only and is not medical advice; consult a healthcare professional before use, especially if pregnant, nursing, taking medication, or managing a medical condition.
9. Product Use & Personal Responsibility — Use only as directed and store properly. Customers are responsible for reviewing ingredients, warnings, and directions, and for determining suitability. Discontinue use if an adverse reaction occurs. Elaré is not responsible for misuse, overuse, improper storage, sensitivity, or failure to follow instructions.
10. Promotions, Intellectual Property & Website Use — Promotions and discounts may change or be withdrawn at any time, and promotional items may be final sale. All site content and branding belong to Elaré and may not be copied or reused without permission. You agree not to use our website unlawfully or to interfere with its operation.
11. Third-Party Services — Our site relies on third-party providers (payments, shipping, fulfillment, marketing, analytics). Elaré is not responsible for their actions, delays, or errors, and their own terms may apply.
12. Limitation of Liability & No Guarantees — To the fullest extent permitted by law, Elaré is not liable for indirect, incidental, or consequential damages, and total liability for any claim will not exceed the amount paid for the product involved. We do not guarantee specific results; results vary by individual.
13. Indemnification — You agree to hold Elaré harmless from claims arising from your use of our website or products, your misuse, your violation of these Terms or any law, or incorrect information you provide.
14. Governing Law & Changes — These Terms are governed by the laws of Spain, to the fullest extent permitted by law. We may update these Terms at any time; continued use after changes are posted means acceptance. Nothing here limits rights that cannot be excluded under applicable law.
